What we need

  • The specification, claims, abstract and drawings to be filed (Word or PDF).
  • Priority application number, date and country, and the WIPO DAS access code if available.
  • Applicant and inventor names and addresses.
  • A power of attorney, which we send you after payment. A signed scan is enough, and it can follow the filing if time is short.

Nothing is payable until a patent attorney confirms your order. Our fees cover filing, reporting and registering the applicant with KIPO; a power of attorney is needed after payment.

Questions applicants ask

What is the deadline to file in Korea with priority?

12 months from the earliest priority date for patents and utility models (Paris Convention). After that, priority can no longer be claimed in the usual way.

Can we file in English?

Yes. Korea accepts a foreign-language application in English. It secures the filing date at once; the Korean translation is due 1 year 2 months from the earliest priority date, or from the Korean filing date if no priority is claimed. Other languages must be translated into Korean before filing.

When are the certified priority documents due?

Within 1 year 4 months from the earliest priority date. No paper copy is needed where KIPO can retrieve the document through WIPO DAS: give us the access code.

When must examination be requested?

Within three years from the Korean filing date. It can be filed together with the application to start examination sooner.

Patent or utility model?

A utility model protects the shape or structure of an article, has lower official fees and a 10-year term. A patent covers any invention, including methods, for 20 years. Both are examined in Korea.

Can a foreign individual get a reduction of the Korean official fees?

Yes. Where every applicant is an individual named as an inventor, the application and examination fees are reduced by 70%, whatever the nationality.
