Questions about Korean annuities
Do you need a power of attorney to pay Korean annuities?
No. In Korea any person may pay registration fees and annuities for the owner, so we can pay as soon as you instruct us. If another Korean firm handles the right, tell it that we are paying so it stops sending reminders.
When are Korean patent annuities due?
The registration fee for years 1 to 3 is due within 3 months of receiving KIPO's decision to grant. From the 4th year, each year's annuity is due by the anniversary of the registration date that starts that year. Late payment is possible for 6 more months with a surcharge of 3% for each month started, up to 18%.
Can several years be paid at once?
Yes. KIPO takes 10% off when 3 or more years are paid at once and none is overdue. Our fee is $40 for the first year in a payment and $20 for each further year.
What does your fee include?
Registration fee: $80, including the report and the electronic registration certificate (PDF). A paper certificate sent by EMS is $50 more, KIPO's reissue fee and postage included. Annuities: $40 per payment plus $20 for each further year paid at the same time. KIPO's official fees are added at cost.
Are there reductions of the Korean official fees?
If every owner is an individual who is also the inventor or designer, whatever the nationality, the registration fee is 70% lower and the annuities from the 4th year are 50% lower. Asking for the electronic certificate takes another KRW 10,000 off the registration fee.
What if the deadline has passed?
Within 6 months of the deadline the annuity can still be paid with KIPO's surcharge, which the online quote includes. After that, the right can be restored within 3 months by paying twice the annuity: contact us at once.
Who pays bank charges?
The client. We need to receive the invoiced amount in full; the invoice is in US dollars and official fees are converted at the daily market rate less 3% for conversion and transfer costs.
