What is the deadline for entering the national phase in Korea?

31 months from the earliest priority date. If the Korean translation is not ready, a one-month extension can be requested up to one month before the deadline.

Do we have to request examination at entry?

No. The examination request may be filed up to three years from the international filing date. Filing it at entry starts examination sooner.

How are Article 19 and Article 34 amendments handled?

We file their Korean translations with the entry papers, before the national phase deadline, so the amended claims become the basis for examination.

Does the applicant in Korea have to match the PCT application?

Yes. Applicant and inventor details must match the international publication or a recorded change. If they differ, we will ask for an assignment document before entry.

Can we use the Patent Prosecution Highway?

If the written opinion of the ISA or IPEA found claims allowable, we can file a PCT-PPH request so that examination starts earlier.
