Questions about Korean fees

How is the Korean examination fee calculated?

A basic fee plus a fee per claim, counted when examination is requested: for a patent KRW 166,000 + KRW 51,000 per claim, so a 15-claim patent costs KRW 931,000.

Who gets the 70% reduction?

Individuals who are named as inventors and file their own application, whatever their nationality: 70% off the application and examination fees. With joint applicants, every applicant must qualify.

Does the International Searching Authority affect the Korean fees?

Yes, for the examination fee only. It is reduced by 70% if the Korean Intellectual Property Office established the international search report or the international preliminary examination report, and by 10% if the European Patent Office was the ISA and its search report is attached to the examination request. Reports by other offices, such as the USPTO, JPO or CNIPA, give no reduction. Only one reduction applies to the examination fee: the larger one.

Why is the fee higher for an application in English?

KIPO charges a higher application fee for a foreign-language application, which is filed in English and translated into Korean later. The same higher fee applies to a PCT entry filed with the translation extension.
